Illinois Carry Ban Overturned by Federal Court

The Illinois ban on civilians carrying firearms has been overturned by the 7th Circuit Court of Appeals. The court has given the Illinois General Assembly 180 days to develop a new state statute that is in accordance with the Second Amendment of the U.S. Constitution and recent decisions of the U.S. Supreme Court on the issue.

Illinois was the last state in the union that did not allow civilians the right to carry firearms.

In the majority decision, Judge Richard Posner wrote that “the Constitutional right of armed self-defense is broader than the right to have a gun in one’s home.”

In 2011, the Illinois House of Representatives failed to legalize concealed carry legislation in a 65-32 vote.
