Fifth Circuit Finds No Jurisdiction Over Foreign Manufacturer


The U.S. Fifth Circuit Court of Appeals has affirmed the dismissal of a products liability lawsuit for “lack of personal jurisdiction” over the affiliate of a now defunct Italian firearms manufacturer.

Litigation in Jackson v. Tanfoglio Giuseppe S.R.L spanned 17 years and resulted in three separate appeals by Fratelli Tanfoglio S.N.C. and family members of an individual fatally injured after dropping his Titan .25 caliber pistol that was claimed to have been manufactured by Fratelli.

On final appeal, the Fifth Circuit agreed with the district court that Louisiana had no personal jurisdiction over Fratelli.
