Retailers, NSSF File Federal Action Against Mass. Attorney General's 'Enforcement Notice'

Four federally-licensed Massachusetts firearms retailers — Pullman Arms Inc. of Worcester; Guns and Gear, LLC of Agawam; Paper City Firearms of Holyoke; and Grrr Gear of Orange — joined by NSSF filed action Thursday in United States District Court for the District of Massachusetts to challenge on Constitutional grounds the "Enforcement Notice" issued by state Attorney General Maura Healey. The lawsuit states that her office overstepped its legal authority and deprived the retailers of their due process protections guaranteed under the U.S. Constitution. The action seeks declaratory relief and a permanent injunction enjoining enforcement.

"Attorney General Maura Healey's actions were unconstitutional. Firearms retailers in Massachusetts cannot determine the meaning or scope of the Attorney General's Enforcement Notice and subsequent explanations," said Larry Keane, NSSF Senior Vice President and General Counsel. "Because criminal penalties can result due to Attorney General Healey's unilateral reinterpretation of a state statute done without administrative process or input from affected parties, her office exceeded its lawful authority and retailers were deprived of their due process protections under the Fifth and Fourteenth Amendments."

N.J. Microstamping Bill Passes Committee

A bill requiring all new handguns being sold in New Jersey to be equipped with unreliable microstamping technology was passed today by the General Assembly's Law and Public Safety Committee, but has been sent to the Appropriations Committee for further review. This is actually something of a positive development, given the general pro-gun control tenor of the Democrat-controlled state legislature. The bill, A-3934, would require new handguns sold in the state to have the make, model, and serial number of the gun etched or printed on components that that would transfer this information onto the cartridge casing when fired. The state would develop and maintain a database of all such–equipped handguns.

The University of California, Davis, in its testing found that only 20 percent of casings recovered from microstamped firearms were legible. In addition, such technology is easily defeated by tools as simple as a nail file. NSSF will continue to oppose passage of this legislation throughout the Assembly's review process.

NSSF Responds to Biased Survey Coverage

NSSF this week responded after media coverage generated in response to a selective pre-release of questionable opinion survey findings to two organizations, one of them funded by anti-gun billionaire Michael Bloomberg. The Northeastern University and Harvard University was financed by the Joyce Foundation, which has long funded gun control causes. This pre-release was not accompanied by an explanation of survey methodology, which makes careful review impossible. The report appears to compare online results with a phone survey conducted in 1994, comparing methodological apples to oranges. Read the NSSF statement.

 

Minnesota Mall Knife Attack Stopped by NSSF Member

The man who stopped a knife-wielding attacker at a crowded mall in St. Cloud, Minnesota, is an NSSF member. Jason Falconer, president and owner of NSSF member business Tactical Advantage also is a law enforcement officer. He was off-duty at the time and shopping at the mall, when he was able to call upon his years of training and legally carried handgun to stop the attacker in his tracks. "This could have been much, much worse" if not for Falconer's "swift and direct" response to the chaos, said St. Cloud Police Chief William Anderson said.
