NSSF is Contesting DDTC's 'Guidance'.
We need your help. Call Your Representative, Senators

NSSF is expressing strong opposition to regulatory overreach in the form of "guidance" that the State Department's Directorate of Defense Trade Controls (DDTC) recently issued ostensibly to clarify who is required under the Arms Export Control Act (AECA) and International Traffic in Arms Regulations (ITAR) to register as a "manufacturer" of "defense articles." DDTC has created considerable confusion among gunsmiths and gun owners.

The Obama administration's own Export Control Reform (ECR) initiative would, with limited exceptions, do away with these AECA and ITAR manufacturer registration requirement and the accompanying onerous fee for commercial and sporting firearms. The proposed rules have been drafted and ready for publication since the summer of 2012. Inaction persists despite congressional testimony and letters from administration officials to U.S. House and Senate members that they would publish the rules. Why? While NSSF has been working with allies in Congress to pressure the Obama administration to complete ECR, the administration has decided that its own gun control politics are more important. It is time for Congress to step in and stop the Obama Administration's gun control agenda from interfering with this needed reform. Call your U.S. Representative at 202-225-3121 and U.S. Senators at 202-224-3121 urge them to support Rep. Collin Peterson's (D-Minn.) Resolution, (H. Res. 829) that demands the Obama administration complete ECR and publish the proposed rules to transfer the licensing of commercial and sporting firearms and ammunition products to the Department of Commerce (which does not require registration or payment of a fee).

In addition, tell your U.S. Representative and Senators that DDTC must stop imposing onerous registration fees on small businesses that do not export products. Tell them to support efforts by House Majority Whip Steve Scalise (R-Louisiana) and Senator Steve Daines (R-Mont.) to include language in the Fiscal Year 2017 State and Foreign Operations Appropriations to address this issue.

 

USFS, NSSF Move to Dismiss Traditional Ammunition Suit

Lawyers for the United States Forest Service today filed a motion in U.S. District Court for the District Of Arizona for dismissal of all claims against it brought in a lawsuit by the radical, anti-hunting Center or Biological Diversity (CBD). The suit charges that hunters' use of traditional, lead-component ammunition in the Kaibab National Forest constituted hazardous waste disposal. NSSF is a party in the case in support of the Forest Service and also filed a motion for dismissal.

 

NSSF Challenge of Mass. AG's Action Draws Media Notice

NSSF's announcement last week that it would undertake legal action to challenge the "Enforcement Notice" issued by Massachusetts Attorney General Maura Healey that would appear to ban the sale of semiautomatic rifles in the commonwealth has received considerable media attention. NSSF Senior Vice President and General Counsel Larry Keane told the Boston Herald, "We believe very clearly that the attorney general does not have the constitutional or statutory authority to promulgate these regulations and to in effect rewrite the statute."

The Boston Globe took note that Smith and Wesson Chairman James Debney, in contributing $500,000 to NSSF's #GUNOTE voter education and registration initiative, cited Healy's action saying, "We are honored to support this effort on behalf of our employees and especially the law-abiding firearm owners of Massachusetts, who have so recently been denied their fundamental rights through arbitrary government action that threatens to turn lawful gun owners and dealers into criminals."

NSSF has retained two law firms to pursue legal action and will keep you apprised of developments.

 

Keane to Speak at GOAL Rally on Monday

The NSSF's Larry Keane will be among the speakers at the Massachusetts "Gun Owners' Action League (GOAL) Call to Action Rally and Fundraiser on Monday, Aug. 15 from 6–9 p.m. at the Boxboro Holiday Inn. GOAL is working with NSSF to oppose the over-reaching gun control actions by Attorney General Maura Healey's office. Tickets are $25 and include an Italian buffet dinner. Other speakers include GOAL Executive Director Jim Wallace and Second Amendment Foundation Founder Alan Gottlieb.

 

NSSF, Suicide Prevention Group Partner on New Program

The American Foundation for Suicide Prevention (AFSP), the nation's largest suicide prevention organization, and NSSF this week jointly announced Project 2025, a first-of-its-kind national plan to build and implement public education resources for firearms retailers, shooting ranges and the firearms-owning community about suicide prevention and firearms.

"One of the first areas identified through Project 2025 was a need to involve the gun-owning community in suicide prevention said Robert Gebbia, AFSP CEO. By joining forces with NSSF, we reach both firearm owners and sellers nationwide to inform and educate them about suicide prevention and firearms, and offer specific actions they can do to prevent suicide."

"The firearms industry has long been at the forefront of successful accident-prevention efforts and programs aimed at reducing unauthorized access to firearms. Since two-thirds of all fatalities involving firearms are suicides, we are now also in the forefront of helping to prevent these deaths through our new relationship with the American Foundation for Suicide Prevention," said Steve Sanetti, NSSF President and CEO.

The two organizations are collaborating on this initiative in Alabama, Kentucky, Missouri and New Mexico. The goal is to take the program nationwide within two years.

 

NSSF Government Relations Team Promotes Two, Welcomes One

NSSF is pleased to announce that Jake McGuigan has been promoted to Senior Director, Government Relations-State Affairs with managerial direction of our government relations objectives and priorities on state governmental affairs.

Trevor Santos has been promoted to Director, Government Relations-State Affairs, reporting directly to Jake.

Diane Cihota will be joining NSSF in our Washington, D.C. office as Director, Government Relations-Federal Affairs on Sept. 12, reporting to Patrick Rothwell, Managing Director, Government Relations-Federal Affairs. Diane has worked for U.S. Jeff Miller (R-Fla) for 11 years, most recently as legislative director. Congressman Miller is retiring at the end of his term.

 

NSSF Team at State Legislators Conference

The NSSF this week sent a team made up of Elizabeth Karasmeighan, Director, Legislative and Policy Research; Trevor Santos and Jake McGuigan to the National Conference of State Legislators (NCSL) annual legislative conference in Chicago. Throughout this event, team members had the opportunity to speak with state legislators and staff members from across the country about many of the key issues affecting our industry, including traditional ammunition, modern sporting rifles, the industry's economic impact and the Don't Lie for the Other Guy program.

Legislators continued to express interest in the NSSF FixNICS campaign. Many commended the industry for taking the lead to ensure that all appropriate records, including adjudicated mental health records, are sent from the states to the National Instant Criminal Background Check System (NICS). The conference offers a great opportunity to conduct discussions with legislators from both parties and their staffers about the challenges facing the industry in their states.

 

Where Have Pro-Gun Democrats Gone?

Despite the drubbing they have taken at the polls in recent years for their anti-gun activism, there is no question that a growing number of the party's elected officials now are firmly established in the gun-control camp. In fact, for leading gun control advocate Sen. Chris Murphy (D-Conn.), being for strict gun-control laws should be a litmus test to even run for office as a Democrat. Yet, it was not that long ago Democrats who supported gun rights were willing to stand up and be counted. Where are they now? Where have they gone?
