Don't Risk Your Rights: #GUNVOTE in 2016

THE POWER OF #GUNVOTE . . . Candidates for political office who fail to support hunting and the shooting sports will not win the votes of American sportsmen. That is the finding of a HunterSurvey.com survey of hunters and target shooters regarding their intentions to vote in the presidential election and how important hunting and shooting sports issues were in casting their votes. Nearly 96 percent said a candidate's position on gun and hunting issues will affect their voting decisions. Read more about this poll.

  • ATF Q&A . . . Many great questions came in on our 24/7 NSSF member compliance hotline last week. One question covers whether an FFL that remains in business beyond 20 years has to maintain Form 4473 records beyond the 20-year holding period. Another question asks what the procedure is for a licensed pawnbroker to return a firearm.

Government Relations

  • SEN. MURPHY ON GUNS: THE FACTS ARE NOT WITH HIM . . . Last year, U.S. Senator Chris Murphy (D-Conn.) was awarded the highest number of "Pinocchios" from the Washington Post's Fact Checker column for using inflated figures on school shootings in America. Despite that scrutiny, the fact-challenged senator continues to manipulate and conflate figures to suit his gun-control agenda. Read more.

  • SUNDAY HUNTING MEASURES ADVANCE . . . The Delaware House of Representatives has passed House Bill 289 to allow deer hunting on five individual Sundays. Some 57 percent of the voters in Jackson County, West Virginia, cast ballots last week to overturn the prohibition on Sunday hunting on private land in their county. The Pennsylvania Senate Game and Fisheries Committee has scheduled a hearing this Wednesday on Senate Bill 1070, to repeal that state's Sunday hunting ban.

  • STATE ROUNDUP . . . The California Senate Public Safety Committee has approved more anti-gun measures, one requiring background checks on ammunition purchases and requiring those selling ammunition to apply and pay for an "ammunition vendor" license, among other things. Anti-gun Illinois legislators introduced measures to mandate costly security standards and operating procedures that will seriously impact FFLs. Owning a suppressor is legal in New Hampshire; however, hunting with one is not. That could change if Gov. Maggie Hassan signs House Bill 500 into law.

Legal

  • NINTH CIRCUIT COURT PANEL FINDS COMMERCE IN ARMS CONSTITUTIONALLY PROTECTED . . . A three judge panel of the U.S. Ninth Circuit Court of Appeals panel today ruled that "the right to purchase and sell firearms is part and parcel of the historically recognized right to keep and bear arms." The opinion came in a case filed by the Second Amendment Foundation, two California Second Amendment organizations and three businessmen. The case challenged an Alameda County ordinance prohibiting gun stores from being located within 500 feet of a residential zone.

  • ARGUMENTS RE-HEARD IN MD. GUN LAW CHALLENGE . . . The full U.S. Court of Appeals for the Fourth Circuit last week heard arguments in Kolbe v. Hogan. A three-judge panel last year directed that strict scrutiny be applied to the question of whether Maryland's "assault weapons" ban violates the Second Amendment. Two judges wondered why, if modern sporting rifles fall outside of the Second Amendment's protections, the state could not ban every new firearm that entered the market. Read the Washington Post account.

  • NSSF RESPONDS TO L.A. MICROSTAMPING APPEAL BRIEF . . . NSSF last week filed a response to a friend of the court brief filed by the City of Los Angeles in the joint NSSF/SAAMI microstamping case on appeal in California state court. LA City Attorney Mike Feuer authored the microstamping law challenged by the NSSF/SAAMI litigation when he was in the California State Assembly. This history is apparent in the amicus brief, which amounts to little more than a lengthy public policy statement. Read NSSF's response.
