SHARE Act Passes U.S. House

The U.S. House of Representatives in a decisive 242-161 vote Friday passed H.R. 2406, the Sportsmen's Heritage and Recreational Enhancement (SHARE) Act. See how your House member voted. Because the SHARE Act is the most important pro-sportsmen and pro-hunting legislation in a generation and a top priority for NSSF, we scored the vote. Twelve Democrats joined the Republican majority to ensure passage. Only four Republicans voted against. All attempts to amend the legislation with unfavorable provisions were defeated.   • HILLARY CLINTON'S ANTI-GUN INDUSTRY POLITICS . . . Hillary Clinton's claim that the Protection of Lawful Commerce in Arms Act confers gun manufacturers with "immunity" is a fiction, writes legal scholar Victor E. Schwartz in the Wall Street Journal. "Instead the 2005 law stands for the unremarkable premise that when a business makes or sells a lawful product, but the product is used in an unlawful way, it is not the fault of the maker or seller. It is the fault of the criminal."

  • HOUSE-PASSED BILL WOULD KEEP SUITS IN FEDERAL COURTS . . . The U.S. House of Representatives has approved an NSSF-supported bill that provides federal judges increased discretion to remove local defendants that are often small businesses from lawsuits filed by trial lawyers attempting to keep cases in more favorable state court jurisdictions. H.R. 3624, the Fraudulent Joinder Prevention Act, would require plaintiffs to demonstrate that their claims are plausible and brought in good faith. The measure would save small business considerable time and money.

  • NSSF CONGRESSIONAL FLY-IN, APRIL 12-13 . . . The 2016 NSSF Congressional Fly-In will be held April 12-13. Every year, the Fly-In provides an outstanding opportunity for leaders from NSSF voting member companies and supporting distributor and manufacturing member companies, as well as leading retailers, to meet with members of Congress. Those eligible can register now.

  • STATE ROUNDUP . . . The Iowa House of Representatives has approved House File 2279 legalizing the ownership and use of suppressors. Currently, 41 states have such a law on the books, while 38 states allow suppressors in hunting. The Kansas House of Representatives has approved HCR 5008 that guarantees the right to hunt, fish and harvest wildlife in that state. HCR 5008 would protect the use of traditional methods and promote wildlife management and conservation, creating a permanent safeguard for sportsmen and conservation.

The third annual Firearms Industry Compliance Conference (FICC), May 2-4 in Atlanta, features three learning tracks and timely discussions of how the regulatory environment has evolved over the past two years.   • EMPLOYEE BACKGROUND CHECKS — YES, YOU SHOULD . . . During NSSF FFL compliance visits, FFLs commonly ask about how to determine if the members of the store team are prohibited from being in active or constructive possession of firearms. This article explores three components you may want to consider adding to your store's employee background check program that can help with such determinations.

  • ALABAMA PISTOL PERMITS QUALIFY FOR NICS EXCEPTION . . . The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has determined that the State of Alabama's concealed carry permit, issued on or after Aug. 1, 2013, qualifies as an exception to a NICS background check for the permit holder. ATF has issued an open letter to Alabama firearms retailers.

  • ATF Q&A . . . Many great questions came in on our 24/7 NSSF member compliance hotline last week. One question asks how an FFL should respond to a police officer's request for an original Form 4473. Another question asks if a juvenile (18 and under) can possess a handgun on the business premises of a licensee.

  • VIOLENCE POLICY CENTER PLAYS THE TOBACCO CARD . . . To believe the latest Violence Policy Center report is to believe that Americans who would like to safely introduce their children to the shooting sports are aiding and abetting what will become a lifelong addiction to firearms with likely violent or self-destructive results. We have long known that gun prohibitionists were borrowing heavily from the anti-tobacco playbook. Now, one long-time gun-control propagandist is being open about it. The NSSF's Larry Keane takes him on.

  • TENNESSEE RECOGNIZES BARRETT .50-CALIBER AS STATE RIFLE . . . Last week, the Tennessee General Assembly passed a resolution that made the Barrett Model 82/M107 Tennessee's official state rifle. "We are honored by the resolution and proud to have our rifle officially recognized within our home state," said Chris Barrett, president of Barrett Firearms, based in Murfreesboro. State Representative Micah Van Huss, a U.S. Marine who used the rifle in combat, initiated the resolution.

  • SCTP SLATES INTERNATIONAL-STYLE CHAMPIONSHIPS . . . The Scholastic Clay Target Program has announced the dates for the SCTP International Style National Championships, starting Monday, Aug. 1, and ending Sunday, Aug. 7, at USA Shooting's International Shotgun Range at Fort Carson, Colorado.   • FEMALE-OWNED FFL NOTES RISE IN FEMALE CUSTOMERS . . . Jeanelle Westrom, who opened Davenport Guns a little more than a year ago, has found that about 30 percent of her sales go to women, reflecting a national trend of increasing sales and shooting sports participation by women, according to a story, which cites NSSF statistics, by KWQC Channel 6 in Davenport, Iowa. Westrom said she sees that more women owning firearms is a good thing for reasons related to safety and recreation. "Not only is it good for themselves and their family, but it's good for the future of our sport," said Westrom.
