  • COURT DECISION RAISES CHALLENGE TO PRE-EMPTION LAW . . . A decision last week by a N.Y. State appellate court has reinstated a lawsuit that seeks to hold liable the manufacturer, distributor and dealer for the criminal shooting of a teenaged basketball player by a gang member in 2003, several years after the gun was sold. In dismissing Williams v. Beemiller, the lower court had cited the Protection of Lawful Commerce in Arms Act (PLCAA), which was passed by Congress in 2005 to shield firearms industry companies from lawsuits that seek to hold members of the industry responsible for the harm caused by the criminal misuse of lawfully sold firearms. The Appellate Division, Fourth Department's ruled, however, that the plaintiff's case could proceed because it fit within an exemption to the PLCAA. The plaintiffs have alleged the firearm was knowingly sold in violation of the laws governing the sale of firearms. In a N.Y. Law Review story, Lawrence Keane, senior vice president and general counsel for NSSF, said, "We respectfully believe that the appellate court badly misconstrued the statute."

  • COOK COUNTY BOARD PRESIDENT WANTS TO TAX GUNS, AMMO . . . From the gun control capital of the heartland comes yet another attention-diverting effort intended to appear as if it would deal with the costs of Chicago's rampant, gang-related violence while helping to fill dwindling government coffers. What would it really do? The answer is all too familiar -- penalize law-abiding citizens who own firearms. Read more.

  • ANTI-GUN STUDY OF RETAILERS UNDERWHELMS . . . Recently, an article appeared in the Journal of Urban Health, "Characteristics of Federally Licensed Firearms Retailers and Retail Establishments in the United States: Initial Findings from the Firearms Licensee Survey" by Dr. Garen Wintemute, director of the Violence Prevention Program, University of California, Davis. Wintemute is perhaps best known for authoring the anti-gun report, "Ring of Fire: The Handgun Makers of Southern California." NSSF last year urged retailers to use extreme caution should they decide to participate in the retailer survey. Read more on the NSSF Blog.

More than 11 million meals were provided to the less fortunate through hunters' donations of game meat in 2010. As a reminder to all hunters to consider sharing their harvest this autumn with those in need, NSSF has developed a new video and webpage that encourage making venison donations to food banks and other charitable meal providers. Read the NSSF press release.

  • FIRST CASE OF CHRONIC WASTING DISEASE IN PENNSYLVANIA IDENTIFIED . . . The Pennsylvania Department of Agriculture confirmed last Thursday the first positive case of Chronic Wasting Disease (CWD) in the state, on a deer farm in Adams County. The disease is fatal in deer, producing small lesions in the brain. The positive sample was taken from a deer tested as part of Pennsylvania's CWD monitoring efforts. The location in Adams County and two farms associated with that positive deer have been quarantined, preventing the movement of animals on or off the premises. The state's interagency task force has implemented its response plan, which includes education and public outreach and minimizing risk factors through continued surveillance, testing and management.
